ARTICLE 1

Section 1

NAME OF ASSOCIATION

This Association shall be known as The Elmhurst Police Benevolent Athletic Association.

ARTICLE 2

Section 1

OBJECT

The object of this Association shall be to promote benefits for purpose of purchasing equipment, assisting in community endeavors, and any other benefits that might arise from time to time for the members in good standing.

ARTICLE 3

Section 1

MEMBERSHIP and QUALIFICATIONS

Be it understood that any person duly appointed as a full time or auxiliary police officer must complete his probationary period before he can be admitted as a member of the Association, and then only upon approval of the membership body.

Section 2

Ali members shall attempt to be active in the endeavors of the Association by attending meetings and actively participating in all Association functions.

ARTICLE 4

Section 1

MEETINGS

Meetings will be held on a monthly basis when possible. A gourum of seven members including one of the officers will be necessary for voting. Meetings will be suspended during the summer months.

Section 2

SPECIAL MEETINGS

Special meetings for the membership body may be called by the President at any time, providing a notice is posted so that all shifts can be properly informed of a special meeting.

ARTICLE 5

Section 1

OFFICERS

Be it ordained that this Association shall consist of three Officers as follows:
(1) President
(2) Secretary
(3) Treasurer

Section 2

Nominations for the office of President, Secretary, Treasurer, and Executive Board Member shall be held at the regular monthly meeting during the month of January of every other year. Any member in good standing with the Association may be nominated for an office. No member can be nominated for more than one office for the same election. Elected Officers will hold office for two years.

Section 3

Be it resolved that prior to the meeting when nominations will be made that a notice shall be posted as to advise the membership body of the election. There will be no voting until the actual election meeting.

Section 4

Any Officer of the Association may succeed himself in office if he so desires upon approval of the membership body through ballot only.

Section 5

Be it resolved that if a member is present at the January Meeting and is nominated for an Office, he can decline the nomination by voice, stating his reasons for declining, which will be recorded in the minutes of the meeting by the Secretary. If the member is not present at the January Meeting, and his name is placed in nomination, he can decline the nomination by writing a letter to the secretary of the association within ten (10) days after the January meeting stating his intention to decline and declaring the reasons for doing so. Members who decline nominations will not have their names appear on the ballot.

Section 6

Results of the January nominations will be placed on a ballot after the ten (10) day period following the January meeting. Ballots will be presented to each member of the association after this ten (10) day period by the secretary of the association. Members will mark their ballots, seal same, and return the ballot immediately to the secretary. Ballots are to be counted and tabulated at the February meeting, and the results of the election to be announced at that time. New officers will take Office at the March meeting. If there is a tie for election to any office, it shall be broken by a vote of the members present at the February meeting.

ARTICLE 6

DUTIES OF OFFICERS

The President shall maintain order and preside over all meetings. He shall appoint all committees and their chairmen. He shall preside over all Executive Board meetings.

The Secretary shall be responsible for the keeping of accurate minutes of all meetings. He shall post all notices and other data concerning the Association. He shall send out all correspondence as he may be directed by the members or by the President. He shall have his minutes available at all regular meetings.

The Treasurer shall be accountable for all funds of this Association and he shall keep a record of all monies spent. He shall submit his books for audit on an annual basis in compliance with the laws governing Illinois Charitable Organizations. He shall report the condition of all funds at every regular monthly meeting of the Association. He shall preside as chairman of the "Ways and Means Committee." He shall pay out monies only with the order of the membership at a regular meeting or by order of the Executive Board. All checks shall be signed by the Treasurer and countersigned by the President.

ARTICLE 7

EXECUTIVE BOARD

An Executive Board consisting of the President, past President, Treasurer, Secretary and one elected member shall decide on all monies spent other than at meetings. The membership body will decide on any other appropriations or expenditures by vote at the regular monthly meeting or special meetings.

ARTICLE 8

Section 1

COMMITTEES

The President shall have the authority to appoint any committee at any time he thinks necessary. The following committees shall be called permanent and shall under all future Presidents hold their names and authority.

(a)A Ways and Means Committee of three members, of which one shall preside as chairman (Treasurer). The duties of this committee shall be to find ways to secure monies for the Association.

(b) An Entertainment Committee of three members, one of which shall preside as chairman, will be appointed by the President. The duties of this committee shall be to devise ways and means of securing entertainment for the enjoyment of the members of the Association.

(c) A Sick Committee of two members. The committee shall be responsible for flowers or gifts sent to the members.

(d) A Publicity Committee of one member whose duties will be to see that the Association gets such favorable publicity pertaining to the affairs that are held from time to time.

(e) A Sergeant at Arms who shall attempt to be at all meetings and who shall maintain order at all times. The Sergeant at Arms shall have the authority to escort any member from the meeting who is not acting like a gentleman or who disturbs the order of the meeting.

ARTICLE 9

Section 1

Be it resolved that all social events and business pertaining to the Entertainment committee, shall be arranged and dated by the chairman and his committee. Consideration shall be taken by the chairman in the planning of social affairs, etc. throughout the year so that the majority of the members will be able to participate in the affairs.

Section 2

Be it further resolved that all members shall cooperate with the chairman in any activities he may designate to the members from time to time.

ARTICLE 10

LOANS

Be it resolved that at no time may a member of the Association make a loan from the funds under any circumstances.

ARTICLE 11

Section 1

VOTING

Be it resolved that in cases where a motion has been made and seconded and there are questions or sign of dissatisfaction among the members, the President shall have the authority to call for a secret ballot. The calling of a secret ballot by the President in any case shall be up to his discretion and his decision shall rule.

ARTICLE 12

Section 1

FISCAL YEAR

The fiscal year for the Elmhurst Police Benevolent Athletic Association will be the calendar year.

ARTICLE 13

Section 1

AMENDMENTS

Any part or the whole of the By-Laws may be amended or annulled provided:

(a) That the amendment or amendments shall be presented and read before the membership at a regular meeting and then be posted in a conspicuous place so that all members will have an opportunity to read and study the same. They shall remain on display until the next regular meeting and then a vote shall be taken thereof.

ARTICLE 14

Section 1

PURPOSE

An opportunity is hereby given to all retired members of this Association to obtain a lifetime membership.

Section 2

QUALIFICATIONS

In order to be eligible for lifetime membership in this Association, the lifetime member must have the following qualifications.

(a) At the time of retirement the member must be a member in the Association.

(b) At the time of retiring, the member must have maintained at least five (5) years membership in the Association.

Section 3

BENEFITS

Upon retirement a member will have the option of receiving a five (5) hundred dollar retirement check or life insurance from the Association in the amount of one (1) thousand dollars payable to the members beneficiary at death. The auxiliary police member will not receive either the five (5) hundred dollar retirement check or the one (1) thousand dollars of insurance from the Association.

All regular police officer members of the Association will have a death benefit of five (5) hundred dollars from the Association. All regular police officer members of the Association will have a death benefit of one (1) thousand dollars if killed in the line of duty.

All auxiliary police members of the Association will receive a death benefit of one (1) thousand dollars if killed in the line of duty. The Association will provide no other death benefit for the auxiliary police officer member.

Section 4

LIMITATIONS

Any lifetime member shall not have the right to vote in this Association nor will he be permitted to hold any elective office in this Association. However, the lifetime member shall be encouraged to attend meetings and voice opinions. A lifetime member shall not be expected to participate in the financial endeavors of this Association.

Section 5

DISABILITY RETIREMENT

To qualify for a disability retirement and receive any retirement benefits, the following qualifications must be met:

(a) The member must have become disabled after January 1, 2981.

(b) At the time of disability the member will have the option of taking the five (5) hundred dollar retirement check or the one (1) thousand dollars of insurance from the Association payable to his beneficiary at the time of death of the member.

(c) The auxiliary police member of the Association will have these options only if his disability is directly resulting from his performing police duties while working for the City of Elmhurst Police Department.

(d) The Association will provide no benefit to the auxiliary police member if he is disabled at any other time.

ARTICLE 15

ATTORNEY FOR THE ASSOCIATION

The Officers of the Association shall have the power to hire an attorney to represent them and the Association in all legal matters pertaining to the Association.
